The following Terms & Conditions and Purchaser Agreement are intended for, but not limited to, the annual Cherry Festival.

bag policy

To ensure a safe, secure, enjoyable environment, and to expedite guest entry, the CFA has implemented and will heavily enforce a “Clear Bags Only” policy. Bags that are clear plastic, vinyl, or PVC, do not exceed 12″ x “12” x 6″ in size, and meet the permitted descriptions are allowed. While permissions are under the discretion of the CFA, bag descriptions may include clear backpacks, clear totes/purses, clear cinch bags, and clear fanny packs that do not have an obstructing logo or color tint.

Diaper bags, small non-clear bags/wallets or without straps (clutch style) that DO NOT exceed the dimensions of 4.5″ x 6.5″ in size, and medical bags/coolers are permitted with a bag search.

Guests who fail to comply with this policy will not be allowed to enter the festival grounds and will not be granted compensation for their general admission.

Searches & Screening

Before entering the festival grounds, all guests will be subject to security searches of bags, strollers, handicap accessible scooters/wheelchairs/walkers with storage compartments, folding chairs, hats/beanies, heavy jackets, and blankets. Searches will be implemented by the CFA’s contracted security company and the festival volunteers/members in red CFA vests/shirts. 

Guests may be asked to show their waistband, be screened, or frisked to ensure that they are devoid of any concealed weapons or anything that can be used as a weapon. Any dangerous or prohibited items WILL be surrendered at the gate and WILL NOT be returned. Such items will be taken into the custody of the Beaumont Police Department and handled accordingly. 

The following items are strictly prohibited:

  • Firearms/knives/pocket-knives/Swiss-army knives/sharp objects that may be used as a weapon.
  • Drugs: alcohol, cannabis, cocaine, fentanyl, hallucinogens, LSD, methamphetamine, MDMA, or any other drugs under the CFA’s discretion.
  • Bicycles, scooters, and skateboards. 

Prohibited items will either be confiscated by the Beaumont PD or disposed of without the possibility of retrieval. Please leave these items at home or in your vehicle. The CFA is not responsible for lost, stolen, or damaged prohibited items. This policy is non-negotiable. Guests who fail to comply with this policy will not be allowed to enter the festival grounds, may be escorted away from its surroundings, and will not be granted compensation for their general admission

dress code

The Cherry Festival is a family friendly event and will uphold certain dress code standards such as follows:

  • All undergarments must be concealed.
  • All articles of clothing (shirts, sweaters/sweatshirts/hoodies, jackets, hats/baseball caps/beanies, etc.)with obscene language, violent graphics, may be considered gang related, or are otherwise objectionable, offensive, or questionable are STRICTLY PROHIBITED.
  • Heavily layered clothing that does not reflect the ongoing weather conditions will be subject to a thorough search and, under the discretion of the CFA, the guest may be asked to return the item(s) of clothing to their vehicle.

Guests who fail to comply with this policy will not be allowed to enter the festival grounds and will not be granted compensation for their general admission.

food & drinks

Outside food, drinks, and alcohol are strictly prohibited from entry except for the following:

  • Baby formula, baby pureed foods (NO GLASS jars, containers, or bottles) and baby/toddler snacks.
  • Unopened/sealed plastic water bottles. The seal MUST NOT be broken.
  • Empty refillable tumblers/drink containers. Contents will be emptied out at the gate.
  • Foods/drinks/candies or snacks permitted only to guests on a special medical diet.

All other food and drinks not listed above, along with the containers that may hold these contents will be disposed of without the possibility of retrieval if the guest decides to not return them to their vehicle.

Animals & Service dogs

The CFA holds a strict “No Pets” policy.

The Americans with Disabilities Act “is the law that protects the civil rights of people with disabilities in many aspects of public life.”

Service dogs who are compliant with ADA regulations are permitted. According to the Americans with Disabilities Act“ Service animals are defined as dogs that are individually trained to do work or perform tasks for people with disabilities.” The following are requirements cited by ada.gov.(https://www.ada.gov/resources/service-animals-2010-requirements/)

  • “Dogs whose sole function is to provide comfort or emotional support [d]o not qualify as service animals under the ADA.”
  • “A service animal must be under the control of its handler. Under the ADA, service animals must be harnessed, leashed, or tethered, unless the individual’s disability prevents using these devices or these devices interfere with the service animal’s safe, effective performance of tasks. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls.”
  • “When it is not obvious what service an animal provides, only limited inquiries are allowed. Staff may ask two questions: (1) is the dog a service animal required because of a disability, and (2) what work, or task has the dog been trained to perform. Staff cannot ask about the person’s disability, require medical documentation, require a special identification card or training documentation for the dog, or ask that the dog demonstrate its ability to perform the work or task.”
  • “A person with a disability cannot be asked to remove his service animal from the premises unless:(1) the dog is out of control and the handler does not take effective action to control it or(2) the dog is not housebroken. When there is a legitimate reason to ask that a service animal be removed, staff must offer the person with the disability the opportunity to obtain goods or services without the animal’s presence.”

It is punishable by law to commit Service Dog Fraud. According to the California Penal Code § 365.7:“

(a) Any person who knowingly and fraudulently represents himself or herself, through verbal or written notice, to be the owner or trainer of any canine licensed as, to be qualified as, or identified as, a guide, signal, or service dog, as defined in subdivisions (d), (e), and (f) of Section 365.5 and paragraph (6) of subdivision (b) of Section 54.1 of the Civil Code, shall be guilty of a misdemeanor punishable by imprisonment in the county jail not exceeding six months, by a fine not exceeding one thousand dollars ($1,000), or by both that fine and imprisonment.

(b) As used in this section, “owner” means any person who owns a guide, signal, or service dog, or who is authorized by the owner to use the guide, signal, or service dog.”

performances & Live Entertainment area

All stage performances are provided for everyone to enjoy as there is no additional charge after general admission. Therefore, seating is on a first-come-first-served basis and may not be reserved with personal items or belongings. Such items left unattended for any time may result in loss or theft and the CFA will not be held responsible.

The Riverside County Fire Department requires unrestricted paths of travel for safety and emergency access. Therefore, there will be no adjusting of chairs in the performance area as paths will be pre-determined and approved by the Fire Marshal. Guests will be required to comply and not obstruct these paths as the CFA will uphold this strict policy for everyone’s safety.

Smoking, vaping, & tobacco use

There is a strict smoke-free/tobacco-free policy while on festival grounds. The CFA strictly prohibits the use of all tobacco and nicotine products such as, but not limited to, cigarettes, e-cigarettes, cigars, vapes, and chew; as well as marijuana/synthetic marijuana, or any other smoking drugs, depressants, stimulants, hallucinogens, inhalants, or analgesics.

Use of any products stated above, or if found under the influence, while on festival grounds will warrant being escorted off the property, will not be granted compensation of general admission, and may face expulsion to all future CFA events

beer tent & alcohol consumption

The purchase of alcohol will only be conducted at the designated beer tent, after age verification with a valid government issued ID and proper wristband application. Alcohol is permitted to be consumed throughout festival grounds, however, WILL NOT be permitted at all in the carnival area or the Cherry Pit.

There is no limit to beer tickets purchased. However, if a member of the CFA or its volunteers suspects or notices illegal acts, such as, but not limited to purchasing alcohol for a minor or enabling alcohol consumption of a minor, the CFA reserves the right to revoke and/or deny alcohol/beer ticket distribution. Such acts may also result in dismissal of festival grounds and will not be granted compensation for general admission or beer tickets sold.

If applicable during the event, pre-purchased beer ticket voucher(s) will only be redeemed at the beer tent after age verification with a valid government ID and proper wristband application. Should voucher(s) be attempted to be redeemed under a minor, the CFA reserves the right to revoke voucher(s)without compensation and alcohol distribution will be denied.

At the discretion of the CFA and its members and volunteers, disruptive/crude/dangerous behavior due to alcohol intoxication will result in denial of further alcohol distribution and may result in dismissal of festival grounds without being granted compensation of general admission or beer ticket purchases

general admission

Child admission will be sold to the purchaser for a child between the ages of 5 and 12. Teen admission is intended for ages 13 to 17. Child and Teen general admission will not be sold separately and may only be purchased with an adult, first responder/military, or senior citizen admission ticket. Children 4 and under may enter the festival free of charge with an adult.

Adults ages 18 to 64 may purchase an Adult general admission ticket. Senior citizens 65+, first responders, and active or retired military may purchase their designated admissions ticket at a discounted price. Guests who purchase the first responder or military ticket must provide the proper form of identification at the gate prior to entry. Should the guest not be able to provide such identification, they will be required to purchase an adult ticket without the discounted benefit and will forfeit the original purchased ticket without compensation.

Weekend passes will be available for purchase in the form of child, teen, adult, senior citizen, and first responder/military. Should the purchaser choose to attend at least one day, but not all four days, with the weekend pass admission, compensation will not be granted

chaperone policy

Due to prior incidents held at the Cherry Festival, the CFA is implementing a strict chaperone policy. All guests 17 years old or younger MUST be accompanied by a chaperone who is at least 21 years old to be admitted into or remain in the venue. The chaperone must present a valid government-issued photo ID with date of birth at ticket entry. If unable to verify proof of age, guests may be denied entry into the venue. One (1)chaperone must accompany no more than ten (10) guests 17 years of age or younger.

In addition, the chaperone must accompany their party during entry, remain inside the park grounds during their visit, and be available by phone throughout their stay. Security and the Beaumont Police Department will enforce this policy. Failure to comply will result in dismissal of festival grounds and compensation for general admission will not be granted.

Should it be known that the minor is found unaccompanied by a chaperone or is being disruptive or confrontational, engaging in or with violent or otherwise harmful behavior (i.e. aggressiveness, bullying, physical altercations, filming or enabling such actions),legal measure maybe taken as well as immediate dismissal off festival property. The adult/purchaser of the minor’s general admission maybe held liable, will not be granted compensation for admission, and may face expulsion to all future CFA events.

violence

The CFA holds zero-tolerance for violence and violent behaviors. Persons who engage in any such behavior, especially those resulting in bodily harm, will be confronted by the Beaumont Police Department, and dealt with accordingly. Such people will be escorted off festival grounds, compensation for general admission as well as other CFA tickets purchased will not be granted and may face expulsion to all future CFA events. Legal action may be taken by the CFA and is at the CFA’s discretion.

carnival grounds

Butler Amusements, Inc. is its own entity and therefore holds its own safety policies and regulations. By purchasing admissions into the Cherry Festival, you are also agreeing to implement all CFA terms and conditions into the carnival grounds. Guests who fail to comply with this policy will forfeit their entry onto festival grounds, will be escorted out and will not be granted compensation for their general admission and other CFA tickets purchased, and carnival ticket and wrist band purchases

acceptance of terms & conditions for the annual cherry festival

By accepting the Terms and Conditions agreement I certify that:

  • I am the responsible person the agreement is referring to, and I am authorized to 1) execute on behalf of the business and 2) accept legal process on behalf of the business.
  • All events run by the CFA are rain or shine events and there will be no refunds given due to any inclement or unexpected weather.
  • I will indemnify, defend, and hold harmless the Cherry Festival Association, all its members, volunteers, contractors and vendors from all liability, claims, damages, or injuries to any person.
  • This agreement is between the Cherry Festival Association and the purchaser.
  • I agree to abide by all procedures and rules stated in the Terms and Conditions Agreement on festival and carnival grounds.
  • I will forfeit all admissions and purchased tickets/passes from CFA and Butler Amusements, Inc. should I choose to break this Agreement.

The Cherry Festival Association, “The CFA”, is a not-for-profit 501(c)(4) organization EIN 95-3803597 and is not affiliated with the City of Beaumont. All proceeds, donations, endorsements, and other financial assets collected throughout the CFA’s events help cover operating expenses, including, but not limited to, payments to local service clubs in exchange for their assistance during CFA events, scholarship donations to appointed Beaumont Unified School District recipients, and payouts to independent contractors in exchange for services provided to the CFA.

The terms and conditions provided are consistent with all CFA events and activities (ex. the Beaumont Cherry Festival, Cherry Festival Parade, etc.) When finalizing purchases, contracts/agreements, or attending any (general admission or chargeless)events hosted by the Cherry Festival Association, you accept and agree to all Terms and Conditions stated.
